PARTICIPANT WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

Dear Participant,

We are delighted to welcome you as a participant in our Race Against Kids' Cancer MG Show event (the “Event”), scheduled for Saturday, September 26, 2026. In consideration of your participation in the event, we kindly ask that you carefully read and sign this Waiver of Liability and Assumption of Risk Agreement.

Assumption of Risks: As a participant, you acknowledge and understand that participating in the Event involves inherent risks, including without limitation the following:

a. Accidents or incidents related to the setup, breakdown, and operation of exhibits.
b. Risks associated with the movement and display of your property and vehicles.
c. Potential exposure to loud noises and other sensory stimuli.
d. General risks associated with large public events.

Release of Liability: In consideration of participating in the Event, you, on behalf of yourself, your employees, agents, representatives, successors, and assigns, hereby release and discharge The Morgan Adams Foundation, Children's Hospital Colorado, its officers, directors, employees, volunteers, sponsors, and agents (collectively referred to as “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action, whether at law or in equity, arising out of or related to any loss, damage, injury, or death that may occur as a result of your participation in the event.

Insurance: It is your responsibility to carry appropriate insurance coverage to protect against any claims or liabilities arising from your participation in the Event. You agree to insure and indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, expenses, and losses arising out of or in connection with your participation in the Event.

Compliance with Laws: You agree to understand and comply with all applicable laws, rules, and regulations in connection with your participation in the Event.

Use of Photographs, Videos, Social Media: By participating in the Event, you agree to grant The Morgan Adams Foundation the irrevocable and unrestricted right to use, reproduce, and publish photographs, videos, and other media captured during the event, which may include images of the participant's property, display, and personnel. This grant includes the right to use such materials for promotional and marketing purposes, including but not limited to print and digital publications, social media platforms, websites, and any other medium now known or hereafter devised. Participant acknowledges that The Morgan Adams Foundation is not obligated to use any of the photographs, videos, or media, and retains the sole discretion to select, edit, and arrange the materials at its discretion. Participant further releases The Morgan Adams Foundation from any claims, demands, actions, or causes of action arising out of the use of the photographs, videos, or media, including but not limited to any claims for defamation, invasion of privacy, or infringement of intellectual property rights.

Survivorship: This agreement is binding on the participant, its representatives, successors, and assigns, and insurers.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Colorado.

By signing below, you acknowledge that you have read, understand, and voluntarily agree to the terms and conditions outlined in this agreement. You further warrant and represent you have the authority and right to bind participant to the terms of this agreement.
